Customer Content Terms

These terms apply when you submit photos, videos or other content to us through our website. Please read them before submitting. By ticking the consent box and submitting your content, you agree to these terms.

1. About us

1.1 MUSCLEIQ is a trading name of HTH Partnership Ltd, a company registered in England and Wales under company number 13133309, whose registered address is Dene Farm, Hole Hill, Dorking, Surrey, RH4 3LS ("we", "us", "our").

2. Definitions

2.1 "Content" means any photos, videos, audio or other material you submit to us through our website.

2.2 "Marketing" means marketing and promoting MUSCLEIQ and its products in any media, including paid advertising (including on Meta, TikTok, Google and YouTube), organic social media, our website and product pages, email marketing, and printed or point-of-sale materials.

3. Your permission to us

3.1 You grant us a non-exclusive, royalty-free, worldwide licence to use, copy, edit, crop, adapt, add text, music or graphics to, and publish your Content, in whole or in part, for Marketing.

3.2 You allow us to permit our agencies and service providers to use your Content for Marketing on our behalf.

3.3 We are not obliged to use your Content.

3.4 You will not receive any payment or other benefit for the use of your Content.

4. If you appear in the Content

4.1 If you, or your voice, appear in the Content, you consent to us using your image, likeness and voice as part of the Content for Marketing.

4.2 We will not publish your name alongside your Content unless you ask us to credit you.

5. Ownership

5.1 You keep ownership of the copyright in your Content. These terms do not transfer ownership to us.

5.2 You waive any moral rights you have in the Content, under the Copyright, Designs and Patents Act 1988, in relation to the uses permitted by these terms. This means, for example, that we do not have to credit you and may edit or crop your Content.

6. Your promises to us

By submitting Content, you confirm that:

• (a) you are 18 or over;
• (b) you created the Content yourself and have the right to grant the permissions in these terms;
• (c) anyone else who appears in the Content, or whose voice can be heard, is 18 or over and has agreed to it being used in line with these terms;
• (d) the Content does not include anyone else's copyright material, such as music, artwork or logos, other than MUSCLEIQ's own; and
• (e) the Content is genuine and shows your own use of MUSCLEIQ products.

7. Withdrawing your permission

7.1 You can withdraw your permission at any time by emailing support@muscleiq.co.uk with details of the Content.

7.2 If you withdraw your permission, we will stop using your Content in new Marketing and remove it from our website and the social media channels we control within 30 days.

7.3 We are not required to recall Marketing that has already been printed or distributed before you withdrew your permission, and we cannot control copies that other people have shared or reposted.

8. Your personal data

8.1 We are the controller of the personal data you give us, including your contact details and your image and voice where they appear in the Content.

8.2 We will use your personal data to process your submission and to use your Content for Marketing in line with these terms, based on your consent. You can withdraw your consent at any time as set out in clause 7.

8.3 Our Privacy Policy, available at muscleiq.co.uk/policies/privacy-policy, explains how we handle personal data and your rights under UK data protection law, including your right to complain to the Information Commissioner's Office.

9. Changes to these terms

We may update these terms from time to time. Any changes will apply only to Content submitted after the updated terms are published, unless you agree otherwise.

10. Your legal rights

Nothing in these terms affects your legal rights as a consumer.

11. General

11.1 If any part of these terms is found to be invalid or unenforceable, the rest of the terms will continue to apply.

11.2 These terms are governed by the law of England and Wales. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction, so if you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
